In light of the six-year dispute between Montres Rolex SA and eBay, the German Federal Supreme Court has ordered the online auctioneer giant to exert more effort to prevent selling counterfeit goods in its site. Germany is the second biggest market of eBay next to United States.
“We expect that this ruling will likely result in increased litigation against us in Germany, although we do not currently believe that it will require a significant change in our business practices,” the eBay in a quarterly regulatory filing with the U.S. Securities and Exchange Commission.
Moreover, eBay also faces 2 lawsuits in France against Christian Dior Couture and luxury goods makers Louis Vuitton Malletier.

Rolex says
It’s difficult for eBay to discover who is selling counterfeit or legitimate goods. This battle will continue to rage in the coming years… how can eBay know if a seller is selling a legitimate Rolex watch? The owner might only have one that was legitamately given to him but has no papers…etc….
This will always be a problem on eBay or any other auction site. Rolex could provide a special badge to legitimate sellers or something like that…
